Terms and Conditions
1. Food Safety & Allergies
• Chef/Caterer prepares food in compliance with New York Department of Health regulations.
• Client must notify Chef/Caterer of any allergies or dietary restrictions at least 21 days prior to the event.
• Chef/Caterer is not liable for allergic reactions or dietary issues if Client does not provide correct information.
2. Food Handling & Leftovers
• Chef/Caterer recommends consumption of food within 2 hours of service to ensure safety.
• Client assumes responsibility for food kept after Caterer’s service period.
• Chef/Caterer is not liable for illness or damages arising from improper storage or consumption of leftovers.
3. Photography & Social Media
• Chef/Caterer reserves the right to photograph food displays and event setups for promotional purposes.
• Client may request in writing that no photos be taken or shared publicly.
• Any photos taken by Chef/Caterer remain the intellectual property of PastorChef LaMario Divinely Inspired Cuisine, LLC.
4. Confidentiality
• Chef/Caterer agrees to keep confidentiality about Client’s private event details.
• Client agrees not to show Chef/Caterer’s proprietary recipes, pricing structures, or internal processes.
5. Indemnification
• Client agrees to indemnify and hold harmless Chef/Caterer, its employees, and agents from any claims, damages, or expenses
arising from Client’s event, except those caused by Chef/Caterer’s gross negligence or willful misconduct.
6. Insurance
• Chef/Caterer keeps general liability insurance and workers’ compensation coverage as required by New York law.
• Client handles obtaining event insurance if required by venue or governing authorities.
7. Venue Access & Facilities
• Client must ensure Chef/Caterer has adequate access to venue facilities, including electricity, water, refrigeration, & serving areas.
• Client handles securing venue permissions for outside professional chef/catering services.
8. Alcohol Service
• Chef/Caterer does not provide or serve alcohol unless separately contracted.
• Client assumes all responsibility for compliance with New York State Liquor Authority (SLA) regulations.
9. Force Majeure:
Neither Party shall be liable for failure to perform due to causes beyond their reasonable control, including but not limited to: acts of God, fire, flood, pandemic, government restrictions, labor disputes, or transportation delays.
10. Dispute Resolution
• Parties agree to try mediation prior to litigation.
• If unresolved, disputes shall be brought in Suffolk County, New York courts.
• Each Party shall bear its own legal fees unless otherwise ordered by the court.
11. Governing Law
This Addendum shall be governed by and construed in accordance with the laws of the State of New York.
